These Terms & Conditions apply to purchases made through poufcph.com and to the use of our website. They should be read together with our Shipping & Returns Policy and Privacy Policy.

By placing an order with POUF, you agree to the Terms & Conditions applicable at the time your order is placed.

Nothing in these Terms & Conditions limits or excludes any rights you may have under mandatory consumer law.

Throughout these Terms & Conditions, “POUF”, “we”, “us” and “our” refer to the business identified above.

Our online store is hosted by Shopify, which provides the e-commerce platform through which we offer our products. All purchases made through poufcph.com are made directly between you and POUF.

Products

POUF offers a curated collection of vintage and pre-owned objects alongside original designs, handmade pieces and new editions.

We make every reasonable effort to describe and photograph each product accurately, including its material characteristics and condition where relevant.

Vintage and pre-owned objects are individual pieces with a previous life and may naturally display characteristics associated with their age and use, including patina, surface variation and signs of wear. Where an item has a known material imperfection, repair or other condition issue relevant to the purchase, we aim to disclose this in the product description and/or photographs.

The age, nature, description, price, condition and information provided about a vintage or pre-owned item at the time of purchase may be relevant when determining whether the item is defective under applicable consumer law. Nothing in this section excludes or limits your statutory rights concerning defective or non-conforming goods.

Handmade and small-production pieces may have minor individual variations in colour, material, finish or form.

We make reasonable efforts to display colours and materials accurately, but their appearance may vary depending on your screen, device and settings.

Measurements stated on product pages are approximate unless expressly stated otherwise.

Availability

Many POUF pieces are unique, vintage or available only in very limited quantities.

We make reasonable efforts to keep availability information accurate. However, an item may exceptionally become unavailable after an order has been submitted, for example because of an inventory error or simultaneous sale.

If we cannot fulfil an order, we will inform you without undue delay. Any payment already received for an item that cannot be supplied will be refunded.

We reserve the right to discontinue products or change the assortment offered through the website.

Prices, Taxes & Payment

Prices are displayed in the currency selected on the website.

Before completing an order, you will be shown the total price payable to POUF, including applicable taxes and any delivery charges payable through checkout.

Available payment methods are displayed at checkout.

For deliveries outside the European Union, local import duties, taxes, customs charges or other charges may be imposed by the destination country. Where these are not collected by POUF at checkout, they may be payable by the recipient. Further information is available in our Shipping & Returns Policy.

We reserve the right to change our prices. Price changes will not affect orders already concluded.

Orders

When you place an order through poufcph.com, you will receive an electronic order confirmation at the email address provided during checkout.

We reserve the right not to fulfil an order where we are legally entitled to do so, including where an item is unavailable or where there has been an obvious pricing or listing error. If this occurs, we will contact you as soon as reasonably possible and refund any payment received for the affected item.

You are responsible for ensuring that the information supplied when placing your order, including your email and delivery information, is accurate and complete.

Errors & Inaccuracies

We take reasonable care to ensure that information on poufcph.com is accurate. Occasionally, however, the website may contain typographical errors or inaccuracies relating to product descriptions, measurements, pricing, availability, delivery or other information.

We reserve the right to correct errors and update information.

Where an error affects an order already placed, we will handle the matter in accordance with applicable law. Nothing in this section limits your mandatory consumer rights.

Shipping & Delivery

We deliver to the destinations made available at checkout. Available delivery methods, delivery charges and any relevant delivery restrictions are displayed on the website and/or during checkout.

Estimated delivery times are provided for guidance unless a binding delivery time has expressly been agreed.

POUF is responsible for goods during delivery in accordance with applicable consumer law.

Right of Withdrawal & Returns

Consumers purchasing online generally have a statutory 14-day right of withdrawal, subject to the conditions and exceptions provided by applicable law.

Where required by law, POUF also provides access to the applicable statutory withdrawal procedure and form.

Nothing in these Terms & Conditions limits your statutory right of withdrawal.

Complaints & Defective Goods

Consumers have mandatory legal rights where goods are defective or do not conform to the purchase agreement.

For purchases governed by Danish consumer law, consumers generally have a two-year statutory right to complain about defects. This also applies to vintage and pre-owned goods.

Whether a vintage or pre-owned object is defective is assessed in light of the individual item and the purchase agreement, including the object's nature, age, condition and the information provided about it before purchase.

Characteristics, wear or imperfections specifically disclosed in the product description or photographs before purchase will therefore form part of the description and condition of the individual item. This does not limit your statutory rights in relation to defects that were not disclosed or otherwise reasonably expected.

Where a defect is covered by your statutory rights, POUF will provide the remedy required under applicable consumer law. Where Danish consumer law applies, the necessary costs associated with remedying a covered defect, including necessary transport costs, are borne by the seller.

Intellectual Property

Unless otherwise indicated, original content created for poufcph.com, including photography, text, graphics, branding and original POUF designs, is owned by or licensed to POUF and is protected by applicable intellectual property law.

The website and its content may be used for personal, non-commercial purposes.

POUF-owned content may not be reproduced, copied, modified, distributed, published or commercially exploited without our prior written permission, except where such use is permitted by applicable law.

References to third-party designers, makers, brands or trademarks in descriptions of vintage and pre-owned objects are used for identification and description and do not imply ownership by or affiliation with POUF.

Use of Website

You may not knowingly use the website for any unlawful, fraudulent or malicious purpose, or in a way intended to interfere with its security or operation.

You may not use the website to infringe the intellectual property or other rights of POUF or any third party.

We may take reasonable measures to protect the website against malicious, abusive or technically harmful activity.

Our website may contain links to or functionality provided by third parties, including payment, delivery and technology providers.

Third-party websites and services that POUF does not operate or control may be subject to their own terms and privacy practices.

POUF is not responsible for the content of independent third-party websites. Nothing in this section excludes or limits liability that cannot lawfully be excluded.

POUF's online store is hosted by Shopify, which provides the technology used to operate the store and checkout.

Products offered through poufcph.com are sold by POUF and not by Shopify.

Liability

Nothing in these Terms & Conditions excludes or limits POUF's liability where doing so would be prohibited by applicable law, or excludes or limits any mandatory rights available to consumers.

To the extent permitted by applicable law, POUF is not responsible for losses that were not reasonably foreseeable as a consequence of our breach or for losses arising from circumstances for which POUF is not legally responsible.

Events Beyond Our Control

POUF will not be responsible for a failure or delay in performing an obligation to the extent that performance is prevented by circumstances genuinely beyond our reasonable control.

If such circumstances materially affect an order, we will take reasonable steps to inform you and minimise the effect of the delay.

Nothing in this section limits any rights you may have under mandatory consumer law.

We may update these Terms & Conditions from time to time to reflect changes to our business, website or applicable law.

These Terms & Conditions and purchases made from POUF are governed by Danish law.

If you are a consumer residing outside Denmark, this choice of law does not deprive you of mandatory consumer protections that apply to you under applicable law.

Nothing in these Terms restricts a consumer's right to bring proceedings before a court having jurisdiction under applicable law.

Severability
